Human rights situation in the Occupied Palestinian Territory, including East Jerusalem, and the obligation to ensure accountability and justice

Note by the Secretariat

1. In its resolution 55/28 of 5 April 2024, the Human Rights Council requested the Independent International Commission of Inquiry on the Occupied Palestinian Territory, including East Jerusalem, and Israel to report on both the direct and the indirect transfer or sale of arms, munitions, parts, components and dual-use items to Israel, the occupying Power, including those that had been used during the Israeli military operation in Gaza since 7?October 2023, to analyse the legal consequences of those transfers, applying international humanitarian law, customary international law related to State responsibility and the Arms Trade Treaty, where applicable, and to present its report to the Council at its fifty-ninth session.
2. In its resolution 58/2 of 2 April 2025, the Human Rights Council reiterated its request to the Commission of Inquiry and requested, instead, that the report be submitted to the Council at its sixty-first session.
3. In a letter dated 6 August 2025 from the Chair of the Commission of Inquiry addressed to the President of the Human Rights Council, the Chair informed the President that, in the light of the ongoing liquidity crisis faced by the United Nations, the Commission of Inquiry had not been in a position to prepare that report.
